Today marked the second trial for Leonard Berry, who had his first thrown out as a mistrial after a female witness admitted to lying on stand.
A separate case against Margaret Berry, Mr. Berry’s sister, was also thrown out after prosecutors found not enough evidence to prove her role in persuading the witness to lie.
Berry is being charged with the aggravated assault of a police officer found strangled with the cord of his radio and left behind in a ditch.
The trial continues tomorrow with Berry’s sentencing process.
